Use of the Service
By accessing or purchasing AnalyticsView from Epik One, Inc., you acknowledge that you have read, understood and agree to be bound by the AnalyticsView Terms of Service. You may use AnalyticsView (the "Service") for reports owned by you or otherwise under your management and control.
Use of AnalyticsView includes supplying information from your Google Analytics profiles(s). We only require that you provide User access to your profiles(s), which allows AnalyticsView to create reports. Since User access provides viewing rights only, we take no responsibility for any changes or modifications to your Google Analytics profile(s) and account(s). Reports from your Google Analytics profiles(s) are not shared and are intended for your use only. In the event that you cancel your AnalyticsView service, we recommend that you remove AnalyticsView from your Google Analytics User Manager.
Please note that Google Analytics™ is the trademark of Google, Inc. and is not affiliated with AnalyticsView. Google, Inc. accepts no responsibility, liability and does not provide support to individuals choosing to use AnalyticsView. You shall not:
1. use the Service to review reports not owned by you or otherwise under your management and control, unless you have received permission from the person or entity who owns or otherwise has management and control of such reports;
2. use the Service to process or permit to be processed the reports of a third party;
3. except as specifically set out above, use the Service to publish, or provide to a third party, any results;
4. alter, merge, adapt, modify, translate, or create derivative works based on the Service; or,
5. access the Service with any automated software program unless you have been granted permission in written consent from Epik One, Inc.
No Additional Rights
You acknowledge and agree that except for the rights expressly granted above, all other right, title and interest in and to the Service, including any and all patent, trademark, copyright, trade secret, intellectual and industrial property rights remain the sole and exclusive property of AnalyticsView™. You are not authorized to use the AnalyticsView™ name or any of its trademarks in any manner whatsoever, absent prior written approval and instruction from Epik One, Inc.
Disclaimer of Warranties and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY OTHER REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING, OR OTHERWISE. ANALYTICSVIEW DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR WITHOUT DELAY. YOU ASSUME THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SERVICE. ANALYTICSVIEW SHALL NOT HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF ANALYTICSVIEW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR THEY ARE FORESEEABLE. ANALYTICSVIEW IS NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. ANALYTICSVIEW MAXIMUM AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE US DOLLAR ($1 USD). THE LIMITATIONS IN THIS SECTION SHALL APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH. SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Payment, Refunds, Upgrading and Downgrading Terms
1. With exception to the free plan, a valid credit card is required to sign up for all AnalyticsView subscription plans. You will be billed for your first month immediately after the seven (7) day free trial period. If you upgrade from the free plan to a paid plan, you will be billed for your first month immediately. To determine which are free or paid, all plans are presented on the AnalyticsView website sign up page. Further inquiries can be submitted to: info@analyticsview.com.
2. The Service is billed in advance on a monthly basis and is non-refundable. The thirty day (30) recurring billing cycle is based on the date you were billed for your first month of service. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
3. In the event that a monthly payment can not be billed due to an invalid credit card, your AnalyticsView account will be suspended until payment is made.
4. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
5. For any upgrade or downgrade in plan level, if applicable, the credit card you provided at sign up will automatically be charged the new monthly rate, and every thirty (30) days thereafter unless the plan is changed or canceled.
Cancellation and Termination
1. You are solely responsible for properly canceling your account. If you wish to cancel, you can do so directly within your AnalyticsView Account. Your Account will be immediately canceled and you will no longer be able to access your Account or stored reports. In the event you do not receive a response within twenty four (24) hours confirming your cancellation, it is recommended that you re-submit your request or contact us via info@analyticsview.com for further assistance.
2. Upon cancellation of your AnalyticsView Account, we recommend that you remove AnalyticsView from your Google Analytics User Manager.
3. AnalyticsView, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other AnalyticsView service, for any reason at any time. Such termination of the Service will result in the deactivation of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your AnalyticsView Account. AnalyticsView reserves the right to refuse service to anyone for any reason at any time.
Modifications to the Service and Prices
1. AnalyticsView reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
2. Prices of all Services are subject to change.
3. AnalyticsView shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Modifications to Terms of Service
AnalyticsView reserves the right to update and change the Terms of Service from time to time without notice. Any new features or enhancements to the current Service shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
